1. Acceptance of the General Terms and Conditions of Sale
These General Terms and Conditions of Sale govern the contractual relationship between:

Our offices are located at 16, chemin du camping in Condrieu. We welcome you by appointment as we are often out on assignment.
Our usual opening hours from March to October: Monday to Sunday, from 9:00 am to 12:00 pm and from 2:00 pm to 7:00 pm.

Any request for a quote and/or reservation by the client implies acceptance of all of these General Terms and Conditions of Sale.
These General Terms and Conditions of Sale shall prevail over any other conditions appearing in any other document, unless otherwise agreed in advance, expressly and in writing.
Reservation
The services offered by Intuitive Trace are available by reservation only. Requesting a quote does not constitute a reservation.
The services we offer can be booked at our office or through the online booking system on our website www.gyropodescondrieu.fr (hereinafter the "site" or the "website"). Our services can also be booked on the websites of our partners, in particular the relevant Tourist Offices.
All reservations must be requested by the client, accompanied by payment of the deposit and/or the full amount of the reservation (depending on the requirements of the high season).
To be considered a "firm reservation," it must be confirmed by us via email. This will mean that the requested payment amount has been validated.
Whether it is paid in part or in full, the final payment must be made before the start of the service, at the latest on the day the service is delivered.
Any service not paid for within this timeframe will be considered unconfirmed by the client. For bookings made through our website, a confirmation email will be automatically sent by us to finalize the reservation.
If you do not receive the confirmation email at least 48 hours before your service date, your booking request is not confirmed, and we invite you in this case to contact us directly by telephone.
No reservations will be accepted via telephone message.
The services provided by Intuitive Trace are offered subject to the availability of transport vehicles and drivers on the day of payment of the reservation.

2. Services
2.0. Insurance – applicable regulations
For its various activities, the company Intuitive Trace has taken out insurance policies covering its professional liability with approved companies.
The company Intuitive Trace operates:
- A bicycle and e-scooter rental business
- A transport activity for own account.
For the provision of the services offered, Intuitive Trace reserves the right to subcontract the work to selected professionals. In the event of subcontracting, you will be informed, and we will provide you with the name of the subcontractor upon request. Intuitive Trace will remain your point of contact.
The services offered by Intuitive Trace are those listed below, to the exclusion of all other services. The client remains solely responsible for their accommodation booking and personal travel arrangements.
Luggage transport and bicycle repatriation services
The transport services (for luggage and bicycles) consist of collecting your luggage and/or equipment from the pre-arranged location and transporting it during the day to your accommodation or any other pre-arranged location. This service can be repeated daily, stage by stage, until the end of your journey, within the areas served by Intuitive Trace.
Booking at our offices or on the aforementioned website allows you to reserve the date and location for your luggage to be collected by our services, as well as the drop-off location. When booking, it is essential to specify the number of bags to be transported. Similarly, for bicycles to be transported, you must specify the desired meeting point, the type of bicycle, and its value. Depending on these criteria, we may decline to collect your equipment. We encourage you to contact us before submitting your request.
Without complete information from the client, Intuitive Trace will not be able to perform the service.
The luggage can be either a suitcase, a sports bag, or a backpack.
Luggage must weigh no more than 15 kg, be in good condition, closed, and in one piece. Any additional bags or equipment are considered extra luggage and will be charged accordingly.
In case of excess weight, Intuitive Trace will ask the customer to take the necessary steps to comply with the 15 kg limit. This may involve transporting an additional piece of luggage at the applicable rate, which was communicated to you for your first piece of luggage.
Luggage must contain only accessories and clothing; no perishable goods, currency, valuables, illicit products, animals, or explosives.
The customer agrees that their luggage will not contain any valuables (over €50), fragile items or medication.
If your luggage contains valuable or particularly fragile items, we encourage you to declare it in advance, before transport, so that the necessary arrangements can be made if required.
Your luggage must be made available to our services by 8:00 AM in the luggage storage area of your accommodation or any other designated location. It will be delivered to your accommodation before 6:00 PM. If you are not present, your luggage will be left in the luggage storage area of your accommodation or any other designated location.
The luggage to be transported must be clearly identified by means of a separate piece of paper clearly bearing the following information:
• Mention: INTUITIVE TRACE,
• Your first and last name,
• Your booking reference (the e-ticket sent with your order)
• Your mobile phone number,
• the number of bags to be transported (especially if you are in a group).
Any baggage that is not clearly identified will not be transported and the customer will remain responsible for their baggage.
Intuitive Trace is responsible for the luggage during transport. The client remains responsible for their luggage, particularly in case of theft or damage at the accommodation, pick-up or drop-off location, and especially in the luggage storage at that location (pick-up or drop-off).
Bicycle repatriation must be booked online. The e-ticket provided with your request must be attached to the bicycle for collection.
The e-ticket for returning the bicycle includes all accessories to be returned with the bicycle. Any other accessories not mentioned on the reservation must be removed.
3. Operation of the online booking system (Addock Open Systems software from the company Alliance Réseaux).
Services related to cycle touring extend along the ViaRhona, exclusively on the middle section from Vienne to Avignon.
Online booking is available for the following services: bicycle rentals, luggage transport, bicycle repatriation.
The locations served by Intuitive Trace are the following accommodation options: guesthouses, campsites, hotels, and bed and breakfasts, excluding all other locations. SNCF TER train stations on Line 5 Vienne-Avignon are also included for bicycle return.
A summary of the selected services with the corresponding price will be sent to you by email upon receipt of your request.
You will then need to make the online payment, at least 50% of the total amount of the service requested.
Registering your booking request implies acceptance of these General Terms and Conditions of Sale in their entirety. The data recorded by the aforementioned computer system constitutes proof of transactions carried out on the website between Intuitive Trace and its customers. By correctly entering your personal information, you will receive a copy of your transaction by email.
No reservation will be accepted without payment.
Upon payment, Intuitive Trace will confirm your booking with an email summarizing your reservation and payment, sent to the email address you provided. If you do not receive this confirmation email, your service is not guaranteed.
4. Prices
All our rates are available on the website and upon request for a personalized quote. Prices are expressed in Euros.
The prices shown include VAT at the rate set by the regulations in force.
The total price shown in the booking summary is the final price, unless there are any changes on the day of service: additional luggage and/or bicycle(s), excess baggage fees, or luggage requiring special handling or care. This price includes the total cost for the booked service(s) with a detailed breakdown of each service.
Intuitive Trace reserves the right to change its prices at any time, excluding prices for services already booked.
5. Means and methods of payment
The following payment methods are accepted: Cash, bank transfers, bank cards (Visa and MasterCard).
Services are payable no later than 8 calendar days before the start of the service. No service is definitively booked until payment is received. Any service request not paid for within this timeframe will be considered unconfirmed by the client and cancelled.
In the case of payment by Credit Card or bank transfer, the reservation is considered confirmed only upon acceptance of the payment or transfer and confirmation of the reservation by Intuitive Trace.
NO RESERVATIONS BY CHEQUE.
Intuitive Trace reserves the right to refuse or cancel any new booking from a customer with whom a dispute exists.
6. Cancellation terms and fees – Right of withdrawal
The customer has fourteen (14) days from the date of payment for the service to exercise their right of withdrawal, unless the service has been fully performed before the end of the withdrawal period and the customer has expressly waived their right of withdrawal prior to the service being performed. If the entire service is not performed, the customer will pay the professional an amount corresponding to the service provided up to the point of notification of their decision to withdraw.
Without prejudice to the right of withdrawal where applicable, any reservation may be cancelled by email, without justification by the customer, under the following conditions:
• At least 15 days before the service is performed: Deposit (50%) forfeited.
• Less than 15 days before the service: full payment is due.
Subject to the cancellation conditions outlined above, any refunds will be issued via the same payment method used by the customer, unless the customer agrees to a different method. The customer will provide all necessary data to Intuitive Trace.
For any refund, a fee of €15 will be deducted from the customer's account, in addition to the sums due for respecting the cancellation deadline.
Any modification to the service will incur a fee of €15. A modification to the service by Intuitive Trace to meet the client's new request cannot be considered a cancellation of the service.
7. Force majeure
Intuitive Trace shall not be held liable, or considered to have failed in its obligations, for any delay or failure to perform when the cause of the delay or failure results from a case of force majeure as defined by French case law. In addition, and for the purposes of this contract, the Provider's inability to perform due to inclement weather, strikes, roadworks, traffic congestion, and road accidents, and any events reasonably beyond Intuitive Trace's control, shall be considered cases of Force Majeure.
In the event of force majeure, Intuitive Trace will inform the client as soon as possible and will make its best efforts to fulfill its obligations, but these may be delayed or cancelled without compensation.
8. Applicable Law – Contract Language
These general terms and conditions of service are written in French. They are governed by French law. The failure of Intuitive Trace or the client to enforce any provision of these terms and conditions at any time shall not constitute a waiver of their right to enforce such provision at a later date.

10. Consumer Disputes - Mediation
In the event of a dispute between Intuitive Trace and the client, an amicable solution should be sought before any legal action.
In the event of a dispute with Intuitive Trace, the customer may use the CNPM MEDIATION CONSOMMATION mediation service free of charge.
In the absence of an agreement between the parties, the dispute may be brought before the competent court.
It is important to note that mediation is only available if the complaint has not already been examined by a judge or another mediator, and provided that an attempt has first been made to resolve the dispute directly with Intuitive Trace through a written complaint. The request for mediation must be made within 12 months of the written complaint. Mediation suspends the statute of limitations.

11. Protection of personal data
The personal data collected from the client is necessary for the execution of the service and the preparation of the corresponding invoice.
The customer's personal data is collected via the website or directly from our services and may be subject to computer processing for the following purposes:
• to carry out operations relating to customer management concerning: the performance of services; invoices; accounting and in particular the management of customer accounts;
• sending our newsletter containing information about our news;
• the development of commercial statistics and/or to enable the evolution of the content of our services;
• monitoring customer relations and customer situations, conducting satisfaction surveys, managing complaints and any subsequent customer questions;
• managing requests relating to your rights regarding the processing of your personal data;
• the management of unpaid invoices and litigation;
• managing customer feedback on the services offered.
The personal information collected is necessary for processing your requests.
The recipient of the data is Intuitive Trace and its subcontractors for the performance of a service (e.g., transportation service). This subcontractor is indicated to the customer when booking the relevant service. Data retention is limited to the time necessary for the operations for which it was collected and in accordance with applicable regulations. In this regard, customer data is retained for the duration of the contractual relationship plus five (5) years, without prejudice to any legal obligations or statutes of limitations.
In accordance with regulations, you have the right to access, rectify, erase, restrict processing of, and transfer your personal data, which you can exercise by contacting the data controller:

You have the right to withdraw your consent to the processing of your data at any time.
The requirement to provide your data is purely contractual and is a prerequisite for the performance of the service. The client may object, free of charge and without providing a reason, to the processing of their personal data. This objection, as well as the failure to provide mandatory information (marked with an asterisk * in the data collection form), may, where applicable, make it impossible to process the client's requests. The data is not subject to automated decision-making, including profiling. In the event of a complaint regarding the processing of your data, you may contact the competent supervisory authority.
